German Real Estate Agent Case: Court Upholds European Investigation Orders

The Nicosia Assize Court rejected a defence objection over the legality of four European investigation orders issued to obtain evidence from Germany.

 

The Nicosia Assize Court on Friday dismissed an objection raised by the defence of German real estate agent Eva Isabella Künzel over the legality of European investigation orders issued in the case.

The court ruled that the Nicosia District Court, rather than the Assize Court, was the competent court to issue the orders.

Künzel is facing a total of 46 charges, including fraudulent dealings in property belonging to others, unlawful use of property without the owners’ consent, and money laundering. The case concerns Greek Cypriot properties in the Turkish-occupied areas of Cyprus.

The ruling related to four European investigation orders issued on July 18 and 26, 2024, and on September 2 and 13, 2024, as part of efforts to secure evidence from Germany.

At the start of Friday’s hearing, the defence also raised an issue concerning interpretation. The court ultimately found that the defendant could follow the proceedings with Polish interpretation, while also ordering that Friday’s ruling be translated into German.
